Customer Terms of Service

SmarterATS is an online hiring tool: job posts, applications, CVs, AI screening, career pages, talent pool, email, and calendar features.

You may use it only for your own company's hiring (not to resell to other companies without our written approval).

• You must give true information.
• You are responsible for passwords and everything done under your account.
• You manage who in your team has access.
• BooCoins are consumed when you perform certain activities (post jobs, process applications, use AI, etc.). Used Coins are not connected to successful hiring of candidates and are not refundable.

Tell us right away if you think someone accessed your account without permission.

You agree to:

• Follow employment and privacy laws in your country
• Hire fairly, do not use the tool for illegal or discriminatory hiring
• Give applicants clear privacy information on your career pages
• Review AI results yourself, AI helps recruiters but does not replace your judgment

You agree not to:

• Hack, scrape, or copy our software
• Upload viruses or harmful content
• Share access with people outside your organization (unless we approve)

• You own your job posts and hiring decisions.
• You are responsible for applicant personal data (CVs, applications).
• We host and process that data for you under our Data Processing Agreement.
• Applicants should read your privacy notice.

AI features (CV parsing, scores, summaries, chat, email drafts) areassistive tools. They can be wrong or biased. You must check results before making hiring decisions.

We do not use your data to train public third-party AI models for unrelated products.

• You pay according to your usage of the service on our website.
• Boo coins cost €1 per 10 Boo coins, bought in whole euros. Prices exclude VAT, which is added at checkout where applicable.
• Fees are usually billed in advance and are non-refundable.
• We may suspend access if payment fails.
• Prices may change on renewal; you will be notified through your email.

Taxes are your responsibility where applicable.

• We own the software, brand, and product.
• You own your content (jobs, notes, candidate data you add).
• You give us permission to host and process your content to run the service.

We may update features. We may suspend or close accounts that break these terms.

We try to keep the service online but sometimes need maintenance or fixes.

• The service is provided "as is".
• We are not liable for hiring outcomes, applicant lies, or decisions you make based on AI.
• Our total liability is limited to the fees you paid us in the last 12 months, except where the law does not allow that cap.

Each party covers its own legal costs unless a court decides otherwise.

• Either side may end for serious breach after notice.
• You still owe fees for time already used.

Confidentiality: we both protect sensitive business information.

Changes: we may update these terms; continued use means acceptance where allowed by law.
